DOMA goes bye bye. :hi: :clapping:

I'm happy to see at least 5 members of the court have read the 14th amendment.
All this for a bowl of borscht.

Except that the Court struck down DOMA under the 5th Amendment:

Syllabus Author wrote:Held:

...

2. DOMA is unconstitutional as a deprivation of the equal liberty of
persons that is protected by the Fifth Amendment. Pp. 13–26.

:fingerhead:

A 14th Amendment Equal Protection holding would incorporate the right to gay marriage and make it binding on all states; something which the Court, based upon a lot of the language in the ruling which emphasized a State's inherent authority to define marriage, seems unlikely to now do.

Slow-
Respectfully,.. the topic?

Don't you mean-

"Good day to be a Gay American"?
Amazes me that the headlines on this subject reads:

"Nation reacts to gay marriage decisions"

As if every single individual human being in this country is simutaneously jumping up and down in the same quagmire of celebration over something stupid-
Now if those folks in Cal. don't stop jumping up and down so hard, soon it could cause an uneven shift of the continent and cause the San Andreas to finally split wide open.
Oops.
Never mind.
Keep jumping! :lol3:

I've exhausted every brain cell I've got trying to figure that out-(all three of 'em  )

Could sure use your help to gain some insight on how much more proud-er I should be to be an American as a result of this ruling, and how it adds to the quality of my life.
Thanks

No one should ever think that because they voted they are entitled to get their way. No one should think that because they created legislation that they are entitled it be made permanent. Especially if what one voted for, or pushed through as legislation is unconstitutional.

Cultures shift. Someday, when everyone in your religion, or white folks, or anyone else gets the short end of the stick because the immoral majority believes they should be treated unfairly. It's these kinds of rulings that are going to save the people being treated poorly.

Our laws protect the people and the constitution. You might be unhappy that Gays got their way. But you should be very happy that SCOTUS recognized DOMA as unconstitutional. Laws that discriminate can be used against anyone - it's best they not take hold.

That's right...
but marriage ha(d)s a definition, by that definition no one (not gays) was being discriminated against.

Let's not pretend this is about anything but votes and money.
The Ds wanted votes, and the gays wanted money.

They had the privilege to get married to a person of the opposite sex, same privilege I had, same privilege you had...
Not discrimination! No one was getting treated any different.

The reason that our Government (and others for 100s maybe 1000s of years) recognized marriage between a man and a women, was to promote responsible reproduction (furthering the future of our (or their) culture(s)).

They promoted this through tax brakes and other benefits...

I want to pose one question to all of you, as a single person (that pays taxes) I am left to foot the bill, what the hell does a gay couple bring to the table that furthers the advancement of our culture that makes them worthy of those tax incentives?
