Let's say I did share the Beam with them and all were so drunk they couldn't see the end of their gun barrels? Aggravate or mitigate your judgment?

I think the determination of whether or not these gentlemen are poachers is dependent upon whether or not the game warden can catch them.

Was this fake gas can guy by chance drinking a can of "coca-cola"? Did his breath smell like your uncle Bobby? Did any of the other alleged accomplice's look at your genital region and then immediately smile and initiate eye contact with you in a contrived manner? The people of the court demand to know...

You break the law you pay the consequences!! Those laws are there for a reason, and the penalties are set at a certain level.

Do some people really violate game laws?
Buy it, use it, break it, fix it,
Trash it, change it, mail - upgrade it,
Charge it, point it, zoom it, press it,
Snap it, work it, quick - erase it,
Write it, cut it, paste it, save it,
Load it, check it, quick - rewrite it,
Plug it, play it, burn it

Worry about it...they could be endangered and I'd vote to have last 7 safe guarded in Assa's backyard until they returned to huntable numbers.

The only issue would be reintroducing them to the wild. No way they'd last without learning to fear gunfire. :hammer:

Poaching is something done to eggs.

I need more specific information to make my decision.

What kind of ducks? All hen mallards? How many were Spoonies?

Plugged shotguns? Lead shot or live decoys?

Either way over the limit is over the limit.

If my family was starving and only IF.
A single .22 shell could put hundreds of pounds of beef in the freezer. 10 ducks over is only a couple meals so the "Trying to feed the family" excuse doesn't fly with me.

It doesn't matter what he did with the ducks or why he "needed" them. You can't steal to feed your family. $300 fine plus replacement value if first offense. Same plus loss of hunting privileges if second or more.

Underradar wrote:Bill shoots ten ducks over the limit and sells them to Rufus for gas money so Bill can drive to work the following week.

Again, what he did with the ducks is irrelevant. You can't steal to put gas in your vehicle. $300 fine plus replacement value if first offense. Same plus loss of hunting privileges if second or more.

Underradar wrote:Clem guides 5 hunters and he lets them shoot 10 ducks over the limit (2 per hunter over). Clem gets a big tip from his clients, and lots of referral business.

More irrelevant information (to me, at least). Five tickets with $300 fines and replacement value if first offense. Same plus loss of hunting privileges if second or more. One ticket for guide with a $500 fine if first offense. Same plus loss of hunting privileges if second or more.

I am ignorant of standard fines, penalty options, and judge's discretion in these cases, so this is just what I think is reasonable
