Can a dog tresspass?

Postby peteyg » Wed Nov 05, 2008 12:43 pm

I've been hunting a few MHAs, and I read that since they're a quasi public/privately owned operation, some areas make you susceptible to tresspass. Now, if you knowck down a bird, you can't go in these "no tresspass areas." But, if you don't retrieve the bird, you get busted for that as well.

Does anyone know if it's legal to send the dog after the bird in the no tresspass area, or does the law apply to people and dogs?
There's something about the outside of a dog that's good for the inside of a man.

There is no “right” given by any authority to trespass upon another’s land or property without permission, even to retrieve wounded game. In some cases, you should, or must make an effort to do so, however, the attempt must meet the legal and practical aspects before proceeding. You are responsible for the actions and or control of your dog.

not in Virginia. You can send your dog to retrieve all day long, it is NOT trespassing. BTW this info came from a Game Warden. A person cannot do it but a dog can.

Yeah, VA and some others States do allow it. Every state / county may have different laws and regs. . . but this Maryland . . . the "Free State" . . . yeah, right . . . HA!
