Bag limit of ducks

Postby Vav » Mon Jan 31, 2011 7:05 pm

I know that the legal possession limit of ducks is double the daliy bag limit. My question is How can anybody be "legal" if they save some of their duck to make sasuage at the end of the season? Because I know that you cannot make sasuage with your legal bag limit unless you add 20lbs. of pig fat then its just not duck sasuage. Also not everybody can eat all their ducks the night they shoot them so would that mean that if one had 14 ducks that they could not go hunting until they eat some? Wanting imput on your opinions on the law of double the daliy bag limit.

I believe the law (in my state) says it does not count towards posession once you reach "your permanant place of residense". Basically I understand it as: if you are camped at your duck spot, or staying in a motel you are under the posession limit, once you are home you can stock up the freezer.

Migratory birds are Federal not State. Bag limit is a bag limit thats it. Poss. limit is all you can have, twice the bag limit no more.
I brought this up a while back. It is posted on the 2 nd page of Mass. State forum by the Mod.bag limits verse Poss.
Don't know how to post it on here. I am sure you can find it on there.

You're allowed twice your daily bag limit, no ifs, ands, or buts. I would bet that most guys have over their possession limit in the freezer. All you gotta do is make sausage or give it away, a lot of it

questions like this display the stupidity of some of the laws put on hunting, fishing, and just game management in general.

POSSESSION AND TRANSPORT
Maximum number of birds that a person
may lawfully possess (includes fresh,
frozen, or otherwise processed) in the
field or in transit to place of permanent
residence
(see pages 14-16, 18 and 21
for possession limits). Game birds shipped
or given to another person for transport
during the season or within 48 hours after
the season closes must be accompanied
by a written note listing the number and
kinds; date killed; name and address of
possessor; and signature, address and
hunting license number of the hunter. Birds
transported more than 48 hours after the
season closes must bear a shipping permit
or metal seal of ODFW. Shipping permits
or metal seals are available at any ODFW
regional or district office and any Oregon
State Police office.
Field Possession Limit: No person may
possess, have in custody, or transport
more than the daily bag limit or aggregate
daily bag limit, whichever applies, of
migratory game birds, tagged or not
tagged, at or between the place where
taken and either (a) automobile or
principal means of land transportation;
or (b) personal abode or temporary or
transient place of lodging; (c) migratory
bird preservation facility; (d) Post Office;
or (e) common carrier facility.
OTHER RESTRICTIONS

taken from current OREGON regs.

So why does it point out "in transit ........" if it doesnt matter?

I am very sure I could be be interpreting this wrong, but that is just how I alway thought it was meant.

Another one o those oft-posted topics. So here ya go, straight from the waterfowler's bible...

TITLE 50--WILDLIFE AND FISHERIES

CHAPTER I--UNITED STATES FISH AND WILDLIFE SERVICE, DEPARTMENT OF THE
INTERIOR (CONTINUED)

PART 20_MIGRATORY BIRD HUNTING--Table of Contents

Subpart D_Possession

Sec. 20.39 Termination of possession.

Subject to all other requirements of this part, the possession of
birds taken by any hunter shall be deemed to have ceased when such birds
have been delivered by him to another person as a gift; or have been
delivered by him to a post office, a common carrier, or a migratory bird
preservation facility and consigned for transport by the Postal Service
or a common carrier to some person other than the hunter.

Your state law is moot. Grind it into sausage, burger, or whatever you choose, but if there's more than two daily limits in your possession anywhere...you're over the limit. Not that anybody other than the ethics police here will ever care... :fingerhead:

can I mail them my buddy Joe, and have him mail his to me?? since the post office will deliver it to me...
we can go round robin like this among everyone...the law was never intended to be enforced at you residence unless you poach the game illegally. If you go out every day and shoot your limit, you are legal freezing 'em in your freezer.

Can't pick and choose the laws you want to abide by.

Pretty tough to call the other guy a dirty bastard if he and his group look at group limits differently than you, when your freezer is flush with greenheads. :hi:

It's only terminated for the giver, as they've now got the recipient on the original sin...

No person. You're right though, Inda'. It's one o those silly violations they use with others to make the offender look more guilty...like using hate in conjunction with crime. It just adds to the tally.

I've never seen a case prosecuted for it in Louisiana. It's a B$ law the way it is written. I got a big extended family that does not hunt with a lot of freezers that I could gift to to get around the law the way it is written if they decide to start being stupid with the enforcement.
