It's worse than a speeder but not as bad as a murderer yet is still a criminal act.
I'm no angel but would prefer to not hunt with guys who'll float a shell.
Choose to follow the law or not. The purpose of a plug is to limit the number of shots a hunter can take to three. Floating a shell is little different than modifying a plug to allow three in the tube.
I see this in same light as shooting before or after legal time, shooting over the limit or out of season. No one is going to die, and you will probably get away with it, but getting away with it does not make it okay. If you are being ethical, you do not do it.
I was dove hunting earlier this year and had my stoeger with me, got checked by the game warden, and he showed me how to float the fourth in my gun. Then he said hey don't do that we will take your gun if you get caught... I had no idea it was possible until he did it.

The question is, is it legal to hunt with a gun that is capable of floating a forth (not all can). If my gun is capable of holding five shots and I only load three, I am in violation so if my gun is capable of holding 4 and I only load 3, am I not in violation?

You can hunt with a gun capable of floating a shell because the gun was not intended to be loaded that way. Most have no idea how to do it and it is kind of a pain in the backside when you are trying to get that extra shell loaded anyway. Well, that and it is unethical and illegal.

1st shot is usually easy. Second shot I am hopefully acquiring a new target and shooting and the third shot is always questionable. Sometimes if I miss on the first two Ill fire the last shot out of frustration :hammer:

You have never taken a shot at the edge of your range? and or have you never wounded a bird? No reason to be like that about it brother just sharing a little comradery and some truthfulness.
Come to think of it I killed my one and only band on a heck of a shot (roughly 50 yards). Sometimes it pays off.
