29.1-521.1 Willfully impeding

In 2010 Delegate Scott Lingamfelter introduce HB486 : Impeding hunting; unlawful for person to put out bait or salt for wildlife in place used by hunters.

The bill was passed.

§ 29.1-521.1 Willfully impeding hunting or trapping; penalty. This law was first passed in 1988. It was updated in 2010.

A. It is unlawful to willfully and intentionally impede the lawful hunting or trapping of wild birds or wild animals. ¶

B. It is unlawful for any person or his agent to knowingly and intentionally facilitate or attempt to cause a violation of subdivision A 4 of § 29.1-521 by putting out bait or salt for any wildlife in any place used or occupied by hunters to hunt wild birds or wild animals. ¶

C. Any person convicted of a violation of this section is guilty of a Class 3 misdemeanor. ¶


History
This law has been modified 1 times since it was first created in 1988. Those modifications are cataloged by “The Acts of Assembly,” a state publication, by year and chapter. Those modifications that can be read on the General Assembly’s website will be linked accordingly. Those modifications are as follows: in 2010 chapter 626.

With the September season less than a week old, has anyone this year experience issues with impeding a hunt by baiting?

I am glad to see those on here have not had any issues with impeding yet. Last year, this related topic was a 4 page thread.

Recently, I had the privileged to review some waterfowling game crime cases similar to the topic. I am glad to see there were people who were convicted in 2011 of violations.

Have not heard of anyone having any issues yet and I am very glad to hear so. Hopefully this year we won’t too many.

Legal fees , that make me think you are the one putting out the bait b/c there wouldn't be any legal fees for reporting a baited spot .

Legal fees would accrue when you sue the dept for not enforcing the code and infringing on your rights to hunt public water.

Not baiting, but definitely impeding...I forgot to mention that in 2011, my youngest son (twenty three at the time) and a buddy were set up legally at the end of a point of marsh near Irvington. Idiot homeowner came out on his lawn yelling and screaming, then took aim at their decoys with his shotgun. Kids were smart enough to pickup and leave, and called the game warden while on the way home. Idiot homeowner was found guilty of impeding, as well as unlawful discharge of a firearm...probation, fine of a couple grand and loss of hunting rights (which he may or may not have had, I don't know). Idiot had hired a good local attorney, who I'm sure some of you know. My son was still at LSU getting his masters and did not even have to testify at the trial.

Now that is the way it is supposed to work. Lucky homeowner didn't get some time for discharging firearm. Probably will lose his right to own a firearm if he was found guilty of a felony! :thumbsup:
